Cops cleared in shooting

Two Toronto emergency task force cops were cleared of wrongdoing by the Special Investigations Unit in the December shooting of a Scarborough man who withstood four Taser zaps.

Jonathan Duarte was wounded by tactical officers who responded Dec. 3 to a violent domestic dispute in which the man’s father had been stabbed.

Before the ETF officers arrived on the scene, police from 41 Division had backed off when they were threatened by a knife-wielding man, SIU director Ian Scott stated in a release.

When ETF officers arrived, Duarte threatened them with a knife.

He ignored commands to drop the weapon while approaching the officers, Scott said. ETF officers used four Tasers but the assailant continued to advance, he said.

Two cops opened fire, each discharging their guns once, hitting him in the stomach.

The man collapsed and he was then taken to Sunnybrook hospital for treatment.

Scott said Duarte is expected to make a full recovery. The man’s father is also expected to survive the attack.

The director said there were no grounds to believe any officer committed an offence and they were justified in opening fire.

“Mr. Duarte represented an imminent threat of grievous bodily harm or death to both the subject officers and the other members of the ETF as he continued to advance towards them with a knife,” Scott stated. “He refused to comply with the officers’ order to drop his weapon, and the deployment of the Tasers was ineffective. Accordingly, no criminal liability may attach to the actions of the subject officers.”
